In February 2026, Judge Rakoff of the Southern District of New York ruled in United States v. Heppner, 25-cr-00503 (S.D.N.Y. 2026) that documents a client created using a consumer AI tool were not protected by attorney-client privilege. The reason: consumer AI platforms collect user inputs, may use them for model training, and reserve the right to disclose them to third parties. That destroys confidentiality — and with it, privilege.
